Subject: Please Stop Playing Politics with Sick Patients

Dear U.S. Attorney John Walsh,

As a medical marijuana patient advocate, I request that you establish a Medical Marijuana Advisory Committee to the U.S. Attorney’s Office for Colorado.

Coloradans widely support the constitutionally-enshrined patient’s right to access medical marijuana, and over 130,000 voting-aged Colorado patients rely on this medicine to alleviate their debilitating illnesses. In light of the widespread support, your recent letter to Colorado Attorney General John Suthers stating that your office maintains the authority to prosecute medical marijuana patients (if they aren’t “seriously ill”) and their providers– even if they are in compliance with Colorado’s laws– is deeply troubling.

While we applaud your office’s wise use of discretion so far in respecting Colorado’s medical marijuana laws, we respectfully ask you to continue to show discretion and not carry out enforcement activities against patients and their providers who are in clear and unambiguous compliance with Colorado law.

Across Colorado, local and state governments have established medical marijuana advisory committees comprised of law enforcement, doctors, district attorneys, patients, providers, and government officials, and such committees have proven instrumental in establishing sensible policies around this emerging issue. Such advisory committees exist in the Colorado Department of Public Health and Environment, the Colorado Department of Revenue, and in various cities and towns across the state.

We strongly and respectfully ask that your office establish a Medical Marijuana Advisory Committee similar to other advisory committees in your office under your Community Outreach and Initiatives Division. The purpose of this committee is to study the benefits and drawbacks of Colorado’s medical marijuana laws and to help focus prosecutorial and investigative resources.
